From First Look to Trial: How AI Helps Build your Case Strategy

By Amy Ambroson Reid, Director, Litigation Solutions & GTM

In the first week, we outlined the three steps for strategically leveraging AI in your litigation or investigation: understanding your data, conducting a RAPID Review, and building your case for trial. Then, we took a deeper dive into your data and RAPID Review, outlining the importance of starting with your relevant dataset. This week, we’ll discuss the importance of using AI as you build your case for trial.

In today’s fast-paced legal environment, the ability to manage, analyze, and act on digital evidence efficiently is more critical than ever. By using AI to unlock critical insights, you gain access to key information, documents, and facts quickly. Instead of waiting until discovery is complete, you can accelerate the process to surface “smoking guns” quickly, build case chronologies, and establish your case strategy from the start.

Digital Fact Binder — Your Living Evidence Base

The journey begins with the First Look, an initial scan of collected data that surfaces potentially relevant documents, which we discussed in Week 2. This happens with our UnitedLex AI consultants in conjunction with Early Case Assessment (ECA) and jumpstarts the process to build your Digital Fact Binder on day one.

Instead of static folders and spreadsheets, AI works with you to build your Digital Fact Binder: a dynamic, continuously updated repository of key evidence built to the specifications and needs of your specific litigation or investigation.

  • AI compiles chronologies, linking events across time and custodians to build a coherent narrative.
  • It identifies hot documents, those most likely to be central to the case, based on relevance, sentiment, and context.
  • Facts are connected across custodians, revealing relationships and patterns that manual review might miss.

Working with your case team and review attorneys, we continue to feed documents into your binder to build a more complete picture as we move through your RAPID Review and secondary review processes.

As litigation progresses, preparation for depositions and trial becomes paramount. AI steps into streamline and strengthen this phase.

  • Transcript summaries are generated automatically, highlighting key testimony and surfacing contradictions or admissions.
  • Witness kits include bundles of relevant documents, communications, and prior statements to support targeted questioning.
  • Thematic evidence bundles group materials by issue, making it easier to present cohesive arguments in court.

Throughout this process, our goal is to ensure that there are no surprises. Opposing counsel should not surface anything you have not already seen prepared for in advance. Our goal through your customized Digital Fact Binder is to ensure you have the information you need early to prepare for trial, ensuring your strategy is evidence-driven from the outset.

Benefits of Agentic AI

Agentic orchestration ensures this binder evolves as new materials are added. Transcripts, exhibits, and summaries are automatically integrated, keeping the evidence base current and aligned with case strategy. This living binder becomes a strategic asset, not just a storage tool.

Agentic AI adds another layer of intelligence by automatically cross-referencing documents, prior testimony, and other relevant data. It flags inconsistencies, identifies corroborating evidence, and surfaces key admissions that might otherwise be buried in the data. This proactive analysis empowers attorneys to prepare more effectively and respond dynamically during proceedings.
